These Terms of Service ("Terms") govern your access to and use of the Shop Local mobile application ("App") provided by Brucira ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years of age to use the App. By creating an account, you represent that:
- You are at least 13 years old (or the age of digital consent in your jurisdiction).
- You have the legal capacity to enter into a binding agreement.
- All registration information you provide is accurate, current, and complete.
2. Account Registration
You may be required to create an account to access certain features of the App. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately at dev@brucira.com if you suspect unauthorised access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.
3. Use of the App
3.1 Permitted Use
You may use the App solely for your personal, non-commercial purpose of browsing local stores and placing orders for delivery or pickup.
3.2 Prohibited Conduct
You agree not to:
- Use the App for any unlawful, fraudulent, or harmful purpose.
- Place fake, duplicate, or fraudulent orders.
- Harass, threaten, or abuse other users, merchants, or delivery personnel.
- Scrape, crawl, or systematically download content from the App.
- Reverse-engineer, decompile, or disassemble any part of the App.
- Introduce viruses, malware, or other malicious code.
- Impersonate any person or entity or misrepresent your affiliation.
- Circumvent any security or access controls.
4. Orders, Payments & Cancellations
4.1 Placing Orders
When you place an order through the App, you are making a binding offer to purchase goods from the relevant merchant. Orders are confirmed once you receive an in-app or email confirmation.
4.2 Pricing
Prices displayed are set by individual merchants and may change without notice. We do not guarantee that prices are accurate at all times. In the event of a pricing error, we will notify you before processing your payment.
4.3 Payments
All payments are processed via third-party payment gateways. By providing payment information, you authorise us to charge the applicable amount. We do not store full payment card details on our servers.
4.4 Cancellations & Refunds
Cancellation is permitted within a limited window after order placement (as indicated in the App). Refund eligibility depends on the merchant's policy and the stage of order fulfillment. Refunds, where applicable, are processed within 5–10 business days to your original payment method.
5. Merchant and Delivery Partner Relationship
Shop Local acts as a platform connecting you with independent local merchants and delivery partners. We are not the seller of goods and are not liable for:
- Product quality, accuracy of descriptions, or expiry of items sold by merchants.
- Delays or failures in delivery by independent delivery partners.
Disputes regarding product quality should be raised with the merchant directly; we will facilitate resolution where possible.
6. Location Services
The App uses your device's location to display nearby stores and assist with delivery. Location access is optional; however, core features such as store discovery and delivery may not function without it. You can manage location permissions through your device settings at any time.
7. Intellectual Property
All content in the App — including but not limited to text, graphics, logos, icons, images, and software — is the property of Brucira or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.
By submitting reviews, photos, or other content ("User Content") to the App, you grant Brucira a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with the App.
8. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRUCIRA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 30 DAYS PRECEDING THE CLAIM, OR (B) INR 500.
10. Indemnification
You agree to indemnify, defend, and hold harmless Brucira and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your infringement of any third-party rights.
11. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice. You may delete your account at any time within the App settings. Upon termination, all rights granted to you under these Terms will immediately cease.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.
13. Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page and updating the "Last updated" date. Material changes will be communicated through the App or via email. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
